US Judge Mandates Freedom of Kilmar Abrego Garcia from Immigration Detention

A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without lawful basis.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.

The situation originates in a mistaken removal to El Salvador in March, which US authorities later acknowledged was an error. After his return to the United States to face alien smuggling allegations, he was held in federal custody.

In her order, the judge noted that the authorities lacks a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

The court challenge center on disputed assertions. Whereas the former administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently denies this claim.
